1. Agreement to Terms
By accessing or using ImaginingAI ("the Service"), available at imaginingai.net, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Service Description
ImaginingAI is an AI-powered photo transformation service. Users upload selfie photos, choose from a variety of artistic styles, and receive AI-generated portrait transformations. The Service is available through our website at imaginingai.net.
3. Account and Authentication
To use the Service, you must sign in using Google OAuth. You are responsible for maintaining the security of your account. ImaginingAI is not responsible for any unauthorized access resulting from your failure to protect your account credentials.
4. Generation Credits and Payments
The Service operates on a credit-based system:
- Free Credits: New users receive a limited number of free generation credits to try the Service.
- Purchased Credits: Additional generation credits can be purchased in various pack sizes. Credit packs, pricing, and availability are subject to change at our discretion.
- Credit Card Payments: Direct credit card payments are processed securely by our payment partner, Lemon Squeezy. Lemon Squeezy acts as the Merchant of Record for these transactions, handling billing, tax collection, and compliance on our behalf.
Each AI generation consumes one credit. Credits are non-transferable and are tied to your account. Credits have no cash value and cannot be exchanged for currency.
5. Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Upload images of other people without their consent.
- Use the Service to create deceptive, misleading, or fraudulent content (e.g. deepfakes intended to deceive).
- Generate images that replicate trademarked characters, logos, or copyrighted likenesses.
- Attempt to reverse-engineer, decompile, or exploit the AI system or any part of the Service.
- Use automated scripts, bots, or other tools to access the Service in a manner not authorized by us.
- Circumvent any usage limits, credit restrictions, or security measures.
Content Moderation: ImaginingAI employs multiple layers of content moderation to ensure responsible use of AI-generated imagery:
- AI Safety Filters: All generations are processed through Google's AI safety filtering system, which automatically blocks harmful, explicit, violent, or hateful content.
- Curated Prompt System: Users cannot create custom prompts or text instructions. All transformation styles are authored and reviewed by the ImaginingAI team before being made available.
- Copyright Protection: Styles are designed to avoid replicating trademarked characters, logos, or copyrighted likenesses. Our prompt design process includes screening for IP infringement risk.
- No Deepfakes: The Service may not be used to create deceptive or misleading representations of real people for fraudulent purposes.
Violations of these policies will result in immediate account suspension and may be reported to relevant authorities.
6. Intellectual Property
- Your Content: You retain all rights to the photos you upload. By uploading photos, you grant ImaginingAI a limited license to process them solely for the purpose of providing the AI transformation service.
- Generated Images: AI-generated transformation results are yours to use for personal or commercial purposes, subject to applicable laws.
- Our Platform: The ImaginingAI platform, including its design, code, AI models, brand, and all associated intellectual property, remains the property of ImaginingAI. You may not copy, reproduce, or distribute any part of the platform.
7. Refund Policy
Due to the digital nature of our product, the following refund policy applies:
- Unused Credits: If you have purchased a credit pack and have not used any of the credits, you may request a full refund within 14 days of purchase by contacting support@imaginingai.net.
- Used Credits: Once generation credits have been consumed (i.e. used to create AI transformations), they are non-refundable. Partially used credit packs are not eligible for a refund.
- Credit Card Purchases (via Lemon Squeezy): Refunds for credit card payments follow the same 14-day unused-credits policy. Approved refunds will be processed by Lemon Squeezy to the original payment method.
- Service Issues: If a generation fails due to a technical error on our side, the credit will be automatically refunded to your account balance. No action is needed.
To request a refund, please email support@imaginingai.net with your account details and the purchase in question.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
9. Service Availability and Disclaimers
The Service is provided on an "as is" and "as available" basis. We do not guarantee:
- Uninterrupted or error-free operation of the Service.
- Specific results or quality from AI-generated transformations.
- That the Service will meet your specific requirements or expectations.
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
10. Limitation of Liability
To the maximum extent permitted by law, ImaginingAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
